Managing rental properties can be challenging, especially if you want a tenant to have to move before their lease ends. There are a number of circumstances in which you can terminate voluntarily. If you are not satisfied with the property and the landlord does not want to make repairs, for example, your landlord may let you move instead of doing the repairs. If you move to another state and find a new tenant for your landlord, your landlord could agree to an early termination. However, if you and your landlord do not agree to the termination and its terms, the termination will be considered a violation rather than a voluntary termination. The landlord then makes it clear that they are willing to offer a certain amount of money if the tenant moves on that date – and leaves the premises intact. If one of the parties – tenant or landlord – does not sign the new moving contract and the matter is taken to court, the judgment is based on the original lease. A lease is terminated voluntarily if the landlord and tenant agree to terminate the lease. Ideally, you sign a termination agreement that sets the moving date and the time the rent is no longer payable, otherwise the tenant could be responsible for the rest of the rental period. To terminate your lease, you and your landlord must agree not only to terminate the lease, but also the terms under which the lease ends.

You need to decide on the last day of moving and the amount of rent you will be owed for the rest of your time on the property. Termination of the lease does not release either party from its obligations under the lease or state law. You still have to pay rent and your landlord must always keep the house in a safe and habitable condition. A voluntary termination is not the same as a termination for breach of the rental agreement. If you do not have a cancellation contract and you and your landlord are in dispute, a court will base its decision on the original lease. It might seem like you`ve breached the lease with the extract, even if you and your landlord have agreed to let you move.
