Considerable progress has been made in the compendium dispute and agreement was reached on Clinical Support Time (CST) and training guides at two conciliation hearings with the Victoria Hospitals` Industrial Association (VHIA) in December. The first hearing of the Compendium at WADA/ASMOF Victoria took place on Thursday 5 September at the Fair Labour Commission (FWC). This hearing provided an opportunity for the parties to present their respective positions on the dispute. The Victorian Hospitals` Industrial Association (VHIA) told the Commissioner that it did not believe that WADA/ASMOF had exhausted all the possibilities offered by the litigation procedure in the agreement and that, therefore, the Commission should not be able to resolve most of the issues raised in the dispute. WADA/ASMOF Victoria disagrees and believes that we have complied with the requirements in litigation proceedings. As you may know, AMA Victoria took an unusual step in August to resolve a dispute with each health service covered by the AMA Specialist Enterprise Agreement. This action was taken after a year of frustration at the lack of progress in the implementation of new clauses in the agreement and after a long dispute over the interpretation of long-term vacation rights. It was also an attempt to unite all parties to the agreement with the outcome of the disputes.

The likelihood of the agreement being reached at this stage is low. This can only be done if the majority of doctors who vote against it in a given hospital vote against it. You have to vote yes to make sure that doesn`t happen. One of our objectives was intergovernmental parity. Current agreements between states have 2% – 2.5% PA wage increases and relatively few changes in employment conditions. This package better positions Victoria in terms of wages and interstate conditions. Yes, on February 14, 2018, the government approved two agreements, each for youth and medical staff. The agreements will be put to a vote by the hospital`s doctors in March. In recent months, AMA Victoria has negotiated, on behalf of our members, VHIA and the government, how the reimbursement of salaries should be applied under the new enterprise agreements. Discussions included whether a physician is entitled to reimbursement if he or she left the public system between January 1 and August 7, 2018, when the agreement came into force. We are pleased to inform you that after these negotiations, physicians who have worked in a public health department are entitled to a total compensation of 9%. No, a number of conditions for specialists (excluding salary increases) are not paid if the tradesman already receives an equal or greater condition.

It is a recognition that we are integrating unregulated conditions into the technical agreement in order to create protected national conditions. We are aiming for a vote and registration of the two agreements at the end of February. During this period, we must finalize both projects with the hospital representatives and the Department of Health and Human Services must submit the final approval projects by the government. Once the authorization is granted, a vote by medical staff is held in accordance with the Fair Work Act. If the majority of doctors (who vote in support), the agreements will be submitted for approval by the Fair Work Commission.
